Equipment Rental Agreement — Moovin Box Ltd

Between: Owner – Moovin Box Ltd  |  Hirer – You. The Owner and the Hirer are collectively the "Parties". You agree to rent the Equipment ordered from MoovinBox, which includes our MoovinBox containers and MoovinDollys.

1. Equipment Rental
The Owner agrees to rent the Equipment to the Hirer and the Hirer agrees to rent the Equipment from the Owner in accordance with the terms set out in this agreement.

2. Term
2.1 The agreement commences on the date the Equipment is delivered to the Hirer and ends on collection of the Equipment by the Owner following the agreed rental period.
2.2 The hire period will be the period selected by the Hirer at the time of booking or agreed in writing between the parties, commencing on the date of delivery and as confirmed in the emailed invoice. The delivery date may be adjusted by agreement between the parties.
2.3 To complete payment, an order will be made on the MoovinBox website during the purchase process.
2.4 If the Hirer retains the Equipment beyond the agreed rental period, they will be liable to pay an additional week's rental for every 7 days the Equipment is held beyond the agreed return date.
2.5 The Hirer agrees they have sole responsibility to make the Equipment available for collection at the agreed location by the end of the rental period. If the Equipment is not made available, additional weekly rental charges will apply as per clause 2.4.
2.6 If the Hirer does not give 24 hours' notice to reschedule a collection appointment, an additional rescheduling or cancellation fee of £30 may be applied.
2.7 The Owner will deliver Equipment to the outside ground-floor door of the Hirer's stated address. The Owner is not responsible for carrying Equipment inside a block of flats or apartments.
2.8 The Hirer is solely responsible for making the Equipment available at a ground-floor external door at the agreed collection time.
2.9 Rental charges will be charged to the Hirer's credit/debit card and are calculated based on the agreed rental period.
2.10 Payment details are held securely by our payment processor (Stripe) for the duration of the rental. The Hirer authorises MoovinBox Ltd to charge any amounts arising under this agreement to that payment method.

3. Cancellation & Refunds
3.1 Cancellations made more than 48 hours before the scheduled delivery date will receive a full refund. Cancellations within 48 hours of the scheduled delivery date may be subject to a cancellation fee of up to 50% of the hire cost.
3.2 Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, consumers have the right to cancel within 14 days of purchase. However, by confirming a delivery date, the Hirer agrees the service will begin before the end of that period and acknowledges the right to cancel may be lost once delivery has taken place.
3.3 If MoovinBox is unable to fulfil a booking, a full refund will be issued to the original payment method.

4. Protection of Equipment
The Hirer agrees:
4.1 to take reasonable care of the Equipment and to be liable for any loss, theft, destruction or damage caused by their negligence or failure to take reasonable care;
4.2 to keep the Equipment properly maintained, allowing for fair wear and tear;
4.3 not to sell, assign, mortgage, charge, underlet or part with possession of the Equipment unless specifically authorised in writing by Moovin Box Ltd;
4.4 that the Owner makes no warranty as to the Equipment's fitness for the Hirer's particular purpose;
4.5 to notify the Police and Moovin Box Ltd immediately in the event of theft;
4.6 that the Equipment remains their responsibility until collected by the Owner;
4.7 to carefully inspect the Equipment on delivery and notify the driver of any damage at that time — failure to do so means the Equipment is deemed accepted in acceptable condition. From delivery until collection, the Hirer is responsible for loss or damage caused by their own actions or negligence;
4.8 that no industrial items, hazardous materials, or anything likely to damage or soil the Equipment shall be placed inside it.

5. Termination
5.1 If Equipment is lost, stolen, destroyed or damaged, the Hirer must notify the Owner immediately. Rental fees continue at the quoted rate until the Owner is fully reimbursed for the Equipment's value.
5.2 The Hirer will be treated as having repudiated this agreement if they: (a) fail to pay any sum due on the relevant date; (b) commit any breach of clause 4.3; or (c) fail to remedy any other breach within 7 days of a written request.
5.3 If Equipment has not been returned after 90 days with no communication, the Hirer will be charged the full retail value (£29.99 per MoovinBox; £39.99 per MoovinDolly) plus the total rental cost accrued, charged automatically to the payment card on file.

6. Liability
6.1 The Owner accepts no liability for loss, damage, injury or death arising from the Hirer's use of the Equipment, except where such liability cannot be excluded by law.
6.2 The Hirer will use the Equipment safely and at their own risk and shall not hold the Owner responsible for loss or damage caused by the Hirer's own actions or negligence.

7. Warranty
7.1 The Equipment may be in used condition. The Owner guarantees it will be in good working order at delivery and will replace it at no additional charge if it is not.

8. Governing Law
8.1 This agreement is governed by and construed in accordance with the laws of Scotland. Any disputes shall be subject to the exclusive jurisdiction of the Scottish courts.
