This Equipment Rental Agreement (this “”Agreement”)

Between: Owner – Moovin Box Ltd

AND

Hirer (You)

The ‘Owner’ and the ‘Hirer’ are collectively the “Parties”

You (the “Hirer”) agree to rent the Equipment ordered from MoovinBox which includes our MoovinBox containers and MoovinBox dollys.

Equipment Rental

1. The Owner agrees to rent the Equipment to the Hirer and the Hirer agrees to rent the Equipment from the Owner in accordance with the terms set out in this agreement.

Term

• The Agreement commences on the date the Equipment is delivered to the Hirer by the Owner and will end on the Hirers’ requested pick-up date.
  • The hire period will last for the period stated in the emailed invoice and delivery date may be adjusted on agreement between the parties.
  • To complete payment terms, an order will be made on the MoovinBox website during the purchase process.
  • Initial payment is for a rental period of 2 weeks (14 days)
  • The Hirer understands that if they request a pick up on Day 15, they will liable to pay for an additional weeks rental.
  • The Hirer agrees that they have the sole responsibility to have the equipment arranged for pick up by the agreed date and that if the equipment is not returned by the agreed date, they will be responsible for an additional weeks rental every week (7 days) until the equipment is returned.
  • If the Hirer does not give 24 hours notice to reschedule Equipment pick up appointments there may be additional pick or cancellation fees applied in the amount of £30.
  • The Hirer acknowledges that the Owner will deliver the equipment to the outside ground floor door of the Hirer’s stated address.   The Owner is not responsible for delivering the Equipment to the inside door of a block of flats or apartments.
  • The Hirer  acknowledges that they are solely responsible for returning the Equipment to a ground floor external door at the agreed pick up time and date.
  • Equipment rental charges will be charged automatically to the Client’s credit/debit card and are calculated based on the equipment pick-up date and time.
  • The Hirer acknowledges that their credit/debit payment card will be kept on file for the duration of the rental agreement.   The Hirer acknowledges and authorises the Owner (MoovinBox Ltd) to charge any amount associated with the stated terms of the rental Agreement.     

Protection of Equipment 

• The Hirer Agrees;
  • to be liable for any loss, theft or destruction of or damage to the Equipment how ever caused.
  • to keep the Equipment properly maintained allowing for fair wear and tear
  • not to sell, assign, mortgage, charge, underlet or part with possession of the Equipment or any interest in it unless specifically authorised in writing by Moovin  Box Ltd.
  • the Owner does not make or give any warranty as to the Equipment’s quality of fitness for the Hirers purpose.
  • Theft of any of the Equipment described in the Schedule will be notified to the Police and Moovin Box Ltd immediately.
  • The Equipment will remain the responsibility of the Hirer until picked up by the Owner in full working order.
  • Upon delivery of the equipment at the Hirer’s location, the Hirer will carefully inspect the equipment to determine whether they have been damaged during delivery. In the event of any such damage, the Hirer will inform the Owner delivery driver and a replacement will be provided. If the Hirer shall fail to notify the Owner of any damages on day of the receipt of the equipment, then the Hirer shall be deemed to have accepted the Equipment as being in acceptable operating condition. During the period of the Hirer’s possession and control of the equipment, all risk of loss, destruction of, or damage to the equipment, from any cause whatsoever shall be borne by the Hirer.

• Industrial items or any other such items considered to potentially damage or soil the bins are not allowed to be placed inside the Equipment under any circumstance.

Termination of Hire Agreement

• The Owner and Hirer agree that;
• if the Equipment is lost, stolen, destroyed or damaged the Hirer will immediately give the Owner notice and Rental fees will continue to be billed to the Hirer at the quoted weekly rate until such time as the Owner is fully re-imbursed with the value of the goods as per this schedule.
• the Hirer will be treated as having repudiated this agreement if the Hirer
  • fails to pay on the relevant due date any weekly Rental or other sum due under this Agreement.
  • commits any breach of clause 3 (c).
  • fails for more than 7 days after a request from the Owner to remedy any other breach of this Agreement.
• If the Equipment has not been returned after 90 days and there has been no communication to extend the rental term, it is assumed that the Hirer wishes to purchase the Equipment and will be charged the full retail value of the equipment, in addition to the cost of the total rental term, however long it shall be, at a rate of £29.99 – MoovinBox; £39.99 – MoovinBox Dolly.  Equipment purchases will be charged automatically to the Client’s credit card and are calculated based on the equipment pick-up date and time.

Liability

• The Owner accepts no liability for the loss, damage, injury or death to any company, firm or person arising in connection with the use by the Hirer of the Equipment including without prejudice the failure of the Equipment.
• The Hirer will use the Equipment in a safe manner and at his/her own risk.   The Hirer shall not hold the Owner responsible for any loss or damages caused by the Hirer’s activity.

Warranty

• The Hirer acknowledges that the Equipment provided will be in used condition.
• The Owner guarantees that equipment is in good operating condition at the time of delivery and will replace at no additional charge otherwise.
